Does bitcoin facilitate illegal trading? Sure, St. Louis Fed Economist David Andolfatto says, but so does the U.S. dollar, gold, etc. Bitcoin transactions travel wallet to wallet, where the wallet identities are disguised. In this sense, using bitcoins is like using U.S. cash in facilitating illegal trades. On the other hand, he points out, wallet histories are publically available (unlike U.S. cash transaction histories). He also notes that bitcoins support a great deal of legal trading. Can bitcoin be regulated? Some countries have issued an outright ban on the use of bitcoin and other virtual currencies. Can bitcoins be taxed? In the U.S., the IRS has recently ruled that, for tax purposes, bitcoins will be treated as property and not as currency. For example, when you buy then sell bitcoins, you must report the resulting capital gain or loss—compliance means added record-keeping costs. The effect of this and similar rulings serves to diminish the attractiveness of bitcoins as a currency—but enforcing a ban is close to impossible, Andolfatto says.

Those in violation of the law face heavy fines or even imprisonment. All citizens involved in transactions using cryptocurrencies have been given three months to register with Thailand's Security Exchange Commission (SEC). The punishment for violations will include fines amounting to double the value of the operation but not less than 500,000 Baht, the equivalent of nearly 15,500 dollars or imprisonment for up to two years. Asia, in general, is looking to implement more regulations for Cryptocurrency exchanges and other fast-growing cryptocurrency-related activities.

Bitcoin price soars as US threatens cryptocurrency law

The price of Bitcoin is still on the up today having shot up in value by almost half over the past week. One Bitcoin is now worth about $11,500, but seven days ago it was valued at just over $8,000. Litecoin has also increased in price by more than 50% in the last week to reach a new price of more than $240, with Ethereum recording a smaller increase to hit $950. Ripple enjoyed a smaller rise in price and is now sitting at $1.14. The continued crypto-bounceback comes as US lawmakers consider new rules or laws to govern the notoriously volatile digital money markets. Both Republications and Democrats think action is needed to address the risks posed by virtual currencies to investors and the financial system. Even free-market Republican conservatives, normally wary of government red tape, said regulation could be needed if cryptocurrencies threaten the American economy. ‘There’s no question about the fact that there is a need for a regulatory framework,’ said Republican Senator Mike Rounds, a Senate Banking Committee member. Carolyn Maloney, a Democratic senior member of the House Financial Services Committee, is another lawmaker advocating for direct oversight of digital assets by the SEC. “A lot of people don’t realize there’s nothing backing these virtual currencies,’ she said. Virtual currencies have existed for years but speculation in them has recently ballooned, along with scams promising investors returns of over 1,000 percent in weeks. In a time of volatile markets, hackers are also active in the sector, stealing $530 million of digital currency from Japanese exchange Coincheck last month. Bitcoin, the best known virtual currency, lost over half its value earlier this year in a ‘cryptopocalypse’ after surging more than 1,300 percent. ‘We have to look carefully at all of the cryptocurrencies and make sure individuals don’t get taken advantage of,’ said Representative Tom MacArthur, a House Financial Services Committee Republican. Regulators globally have raised the alarm over cryptocurrencies, saying they may aid money laundering and terrorist financing, hurt consumers and undermine trust in the global financial system. France and Germany want cryptocurrencies on the agenda for the upcoming G20 meeting of the largest advanced and developing economies.

The answer is, it’s none of them. It’s software so it depends how you use it. One minute it acts like a currency, the next minute like a commodity, the next minute a utility token and on it goes. It’s like a slippery eel. Try and regulate it one way and it changes form, wriggling right out of your hands. The other part of this comedy show is that because regulators can’t decide how to classify crypto, they don’t know which agency is responsible. Here’s an extract from the Forbes article on this [red]. The bill in question is House Bill 70 aka The Utility Token Bill, which was passed on the 7th of March. So this legally defined which types of crypto tokens are utility tokens. They are tokens that are not offered as an investment and must be a vehicle for exchange of service. I have a question. Why is Wyoming doing this? What is their incentive? Please share your opinions on this in the comments. --- 3:30 Story - Coinbase ‘Paves Way’ For New Altcoin Support With ERC20 Upgrade https://cointelegraph.com/news/coinbase-paves-way-for-new-altcoin-support-with-erc20-upgrade So to my mind this means two things. Once they technically implement this, you’ll then be able to participate in ICOs by sending Ether directly from your Coinbase wallet. That is something ICOs specifically tell you not to do right now and it’s because the wallet you’re sending from at Coinbase doesn’t allow you to access the tokens you’ll be buying. Now though you should be able to do this, making it that much easier to get your fiat into Ether at Coinbase and then buy ICO tokens. Coinbase may well expand it’s exchange to allow trading of ERC20 tokens. Having said that, they’re unlikely to launch a whole range of them since they’ve already made it clear how deeply they scrutinise a coin before launching support for it. So this may make it easier to get your money into ICOs, but we’re unlikely to be able to use Coinbase as a one stop shop to get the money out again. If you want to convert back to fiat that is. --- 4:43 Story - Statis Group publish their analysis of ICO quality https://medium.com/satis-group/ico-quality-development-trading-e4fef28df04f I’ve noticed this pie chart doing the rounds so I felt I had to talk about it for fear of the information being misrepresented. The problem is that the image is being passed around without reference to the source material. This analysis was done on ICOs with a market cap of at least $50m. According to their analysis 81% of ICOs they studied were scams. Which they define as [red]. Then of all ICO coins that managed to get listed on an exchange they assessed whether the project had a test version, a transparent roadmap and code added to their GitHub within the last 3 months. 3.8% were deemed successful, meaning they had all 3. 1.6% were deemed promising, meaning they had 2 out of those 3. And 2.8% were dwindling, meaning they had 1 or none of the 3. My view on this is that the scams could easily have been prevent by a DAICO, where the funds are locked in a smart contract and only released gradually as milestones are completed. And as for the other success statistics, they seem reasonably on par with average startup failure rates, it just seems that everything is accelerated in the crypto space. The socio-economic debate surrounding money has advanced since the early metallist days of John Locke. Money is no longer viewed as an homogenous, neutral thing; rather, theorists are wont to emphasise its pivotal role in shaping networks of social relations. Yet, in many respects, the legal analysis of money is playing catch-up, and the advent of distributed online ecosystems such as Bitcoin and Ethereum has pushed to the fore some difficult questions concerning the appropriate legal lens through which to view money, and monetary assets. If we are to produce robust answers, these questions must be explored with the benefit of interdisciplinary insight. Before its approval into law, the royal decree drafts must be reviewed and vetted by Thailand’s Council of State, a number of qualified law councilors with experience in areas including law, economics, social sciences and more. The drafts will also be formally reviewed and discussed by the country’s financial authorities including the Finance Ministry, the Bank of Thailand, the Securities and Exchange Commission and the Anti-Money laundering Office – jointly with the Council of State – as early as next week, as assigned by the cabinet. Wissanu further revealed progress in working toward broader ‘organic laws’ by the Finance Ministry and the SEC wherein all digital asset transactions, including trades on cryptocurrency exchanges and those between brokers and dealers, will have to be registered with the relevant authorities. Cryptocurrencies, digital tokens issued through ICOs and other assets in the form of electronic data are all classified as digital assets by Thailand’s Finance Ministry. The cabinet’s approval of the two draft decrees come within days of Thailand’s central bank governor confirming upcoming regulations for the cryptocurrency sector sometime in April. The train has left the regulation station as Russia prepares to submit their draft law on controlling regulating the country’s booming crypto industry.. The wheels continue to turn as Russia moves forward with its plan to regulate cryptocurrencies and ICOs within the country and to provide a definitive framework for trading in the industry.. According to EconoTimes, Russia’s Finance Minister, Anton Siluanov, had this to say: ";The Ministry of Finance has prepared a draft law, currently under consideration, which will determine the procedure for issuing, taxing, buying and circulation of cryptocurrency.". State-operated news agency RIA Novosti has reported that the draft will be submitted on the 28th of December. Anatoly Aksakov, who is the chairman of the State Duma committee for the financial market, has said, through a rough translation, that cryptocurrencies will be known as “other properties”:. "There will be a final evaluation before the presentation of the bill. [Whether it is] Bitcoin or Ether, all cryptocurrencies [will be known as] other property.". Aksakov has stressed that the draft law is actually in the interest of crypto holders: "The problem is that we already have a lot of people who acquire[d] cryptocurrencies and they are deceived, we need to give people the opportunity to work legally with it, to protect them as much as possible.". Even though Russia is aggressively pushing their regulation efforts, they are not immune to the charms of virtual currencies, previously announcing that they too will be part of the crypto revolution by launching their own digital currency, the CryptoRuble..
